TERMS OF SERVICE, LIABILITY WAIVER & CONSENT AGREEMENT

Effective Date: September 1, 2025

IMPORTANT — PLEASE READ CAREFULLY BEFORE REGISTERING OR PARTICIPATING. BY COMPLETING REGISTRATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.

1. Introduction and Acceptance of Terms

These Terms of Service, Liability Waiver, and Consent Agreement (collectively, the “Agreement”) govern your participation in all events, programs, tournaments, showcases, and activities organized or operated by Pathway Hockey (the “Organization”), including but not limited to the Pathway Hockey Tournament and the Origins Girls Hockey Showcase (collectively, “Events”).

This Agreement is entered into between Pathway Hockey and the parent or legal guardian (“Guardian”) acting on behalf of the minor participant (“Participant”). By completing registration, submitting any forms, paying any fees, or allowing the Participant to attend any Event, the Guardian agrees to all terms and conditions set out herein.

Pathway Hockey operates in the Province of Alberta, Canada. This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Alberta.

2. Eligibility and Registration

2.1 Participant Eligibility

Participants must meet the age, division, and skill requirements established by Pathway Hockey for each specific Event. Registration constitutes confirmation that all eligibility criteria have been met. Pathway Hockey reserves the right to verify eligibility and to disqualify Participants who do not meet the stated criteria.

2.2 Registration Requirements

Valid registration requires:

• Completion of all required registration forms with accurate information
• Payment of all applicable registration fees by the stated deadline
• Submission of a valid, fully executed player roster in the required format
• Proof of valid hockey association registration (e.g., Hockey Alberta, Hockey Canada)
• Compliance with any additional documentation requirements communicated by Pathway Hockey

2.3 Guardian Representation

By registering, the Guardian represents and warrants that: (a) they are the parent or legal guardian of the Participant and have full legal authority to bind the Participant to this Agreement; (b) all information provided during registration is accurate and complete; and (c) the Participant is in good physical health and is medically fit to participate in the Event.

3. Assumption of Risk

THIS SECTION CONTAINS AN ASSUMPTION OF RISK. READ CAREFULLY.

3.1 Inherent Risks of Hockey

The Guardian acknowledges and accepts that ice hockey is a physical contact sport that involves inherent and significant risks of personal injury, including but not limited to:

• Sprains, strains, contusions, lacerations, and fractures
• Head injuries, concussions, and traumatic brain injury
• Neck and spinal injuries
• Eye and facial injuries
• Dental injuries
• Cardiovascular events
• Injuries caused by contact with other players, boards, ice surfaces, hockey sticks, or pucks
• Injuries occurring in locker rooms, arenas, parking lots, and other associated facilities
• Permanent disability or death

3.2 Voluntary Participation

The Guardian voluntarily chooses to allow the Participant to take part in the Events, fully understanding the nature of the risks involved. The Guardian confirms that the Participant’s participation is voluntary and that they have had the opportunity to ask questions regarding the nature of the activities and the associated risks.

3.3 Off-Ice Risks

The Guardian further acknowledges that risks also exist in connection with activities that occur off the ice surface, including but not limited to:

• Travel to and from Event venues, including driving, carpooling, or other transportation
• Warm-up and cool-down activities
• Use of locker rooms, washrooms, hallways, and common areas
• Interactions with other participants, spectators, volunteers, or staff
• Slips, trips, or falls on arena premises
• Illness or allergic reactions

4. Waiver and Release of Liability

THIS SECTION CONTAINS A WAIVER OF LEGAL RIGHTS. BY REGISTERING, YOU GIVE UP CERTAIN RIGHTS TO SUE. READ CAREFULLY.

4.1 Release of Liability

In consideration of the Participant’s participation in Pathway Hockey Events, and to the fullest extent permitted by the laws of Alberta and Canada, the Guardian, on behalf of themselves, the Participant, and their respective heirs, executors, administrators, legal representatives, successors, and assigns, hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Pathway Hockey, its organizers, directors, officers, volunteers, employees, contractors, sponsors, facility owners and operators, and any other associated parties (collectively, the “Released Parties”) from any and all claims, demands, losses, damages, costs, actions, or causes of action of any nature whatsoever, arising out of or in connection with the Participant’s participation in any Pathway Hockey Event, whether such loss or damage is caused by the negligence of the Released Parties or otherwise.

4.2 Scope of Release

This release applies to:

• All injuries, illnesses, and medical conditions sustained during or in connection with participation in Events, whether on or off the ice
• All incidents occurring on arena premises, in locker rooms, in parking lots, or in any other venue associated with an Event
• Incidents arising during travel to or from Events
• Loss of or damage to personal property
• Claims arising from the actions or omissions of coaches, referees, officials, volunteers, or other participants
• Claims arising from equipment failures or facility conditions
• Any emotional distress, reputational harm, or other non-physical damages

4.3 Indemnification

The Guardian agrees to indemnify and hold harmless the Released Parties from and against any and all claims, costs, losses, damages, and expenses (including reasonable legal fees) arising from the Participant’s participation in any Event, including claims brought by the Participant or any third party in connection with such participation.

4.4 Limitation of Liability

To the maximum extent permitted by applicable Alberta law, the Released Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to participation in Pathway Hockey Events, even if advised of the possibility of such damages. In all cases, liability of the Released Parties, if any, shall be limited to the registration fees paid by the Guardian.

5. Emergency Medical Authorization

5.1 Consent to Emergency Treatment

In the event the Participant requires emergency medical attention and the Guardian cannot be reached in a timely manner, the Guardian hereby authorizes Pathway Hockey and any Event personnel to: (a) seek immediate emergency medical attention on behalf of the Participant; and (b) consent to such medical treatment as may be recommended by qualified medical personnel, including emergency transportation to a medical facility.

5.2 Medical Expenses

The Guardian acknowledges and agrees that they are solely responsible for all medical expenses incurred by or on behalf of the Participant, including but not limited to ambulance fees, emergency room fees, hospital costs, and any follow-up medical care. Pathway Hockey shall not be responsible for any such costs.

5.3 Health Disclosure

The Guardian is responsible for ensuring that Pathway Hockey is informed of any medical conditions, allergies, or physical limitations that may affect the Participant’s safe participation in Events. Failure to disclose relevant medical information shall not give rise to any liability on the part of the Released Parties.

6. Code of Conduct and Disciplinary Policy

6.1 Participant Conduct

All Participants are expected to conduct themselves in a manner consistent with the values of fair play, respect, and sportsmanship. Participants must:

• Comply with all rules of play as established by Hockey Canada and Pathway Hockey
• Respect opponents, officials, coaches, volunteers, and spectators at all times
• Refrain from any form of bullying, harassment, or discriminatory behaviour
• Comply with all arena rules and regulations
• Report injuries or unsafe conditions to tournament officials promptly

6.2 Guardian and Spectator Conduct

Guardians and spectators are also expected to behave respectfully at all times. Pathway Hockey reserves the right to remove any Guardian or spectator from Event premises for disruptive, abusive, or threatening behaviour. Such removal shall not entitle the removed individual to any refund.

6.3 Disciplinary Action

Pathway Hockey reserves the sole and absolute right to suspend, disqualify, or expel any Participant or team from an Event for violations of this Code of Conduct or any applicable hockey rules, without refund and without liability to Pathway Hockey. All decisions regarding discipline are final.

7. Communications Consent and Privacy (CASL)

7.1 Express Consent

By submitting a registration form and checking the consent box, the Guardian confirms that they are the parent or legal guardian of the Participant and consents to receive event information, updates, and promotional communications from Pathway Hockey via email and other electronic channels.

7.2 Withdrawal of Consent

The Guardian may withdraw their consent to receive commercial electronic messages at any time by clicking the unsubscribe link in any Pathway Hockey email or by contacting us directly at the contact information provided below. Withdrawal of consent will be processed within ten (10) business days. Note that certain non-commercial communications (such as safety or event-critical notices) may continue to be sent as necessary.

7.3 Canada’s Anti-Spam Legislation (CASL) Compliance

Pathway Hockey complies fully with Canada’s Anti-Spam Legislation (S.C. 2010, c. 23) (CASL) and all applicable federal privacy legislation including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, Alberta’s Personal Information Protection Act (PIPA). Pathway Hockey will not sell, share, or disclose personal information to third parties without consent, except as required by law.

7.4 Collection and Use of Personal Information

Personal information collected during registration (including name, date of birth, contact information, and health information) is used for the purposes of administering Events, communicating with Guardians, ensuring participant safety, and fulfilling legal obligations. Personal information is retained only as long as necessary for these purposes.

8. Media, Photography, and Video Consent

8.1 Grant of Licence

By registering, the Guardian grants Pathway Hockey a perpetual, irrevocable, royalty-free, worldwide licence to use the Participant’s name, likeness, image, voice, and any photographs or video footage of the Participant captured during Pathway Hockey activities, provided by a parent or legal guardian, or obtained from publicly available sources (including websites and social media platforms), for promotional, marketing, communications, and archival purposes, in Canada and internationally, without compensation.

8.2 Permitted Uses

Permitted uses include but are not limited to:

• Social media posts and digital advertising
• Website content and photo galleries
• Print materials including brochures, posters, and banners
• Video content for streaming or broadcast
• Media releases and news publications

8.3 Opt-Out

Guardians who do not wish to grant this licence must notify Pathway Hockey in writing prior to the commencement of the relevant Event. Opt-out requests received after an Event has commenced cannot guarantee the removal of content already captured. Pathway Hockey will make reasonable efforts to comply with late opt-out requests but cannot guarantee removal from all third-party platforms.

9. Registration Fees, Payments, and Refunds

9.1 Registration Fees

All registration fees must be paid in full by the deadline specified in the applicable Event registration materials. Registrations will not be considered confirmed until full payment is received.

9.2 Refund Policy

Refund requests must be submitted in writing to Pathway Hockey. The following schedule applies:

• Cancellations received more than 30 days prior to the Event start date: full refund less a $50 administrative fee per team
• Cancellations received 15 to 30 days prior to the Event start date: 50% refund
• Cancellations received fewer than 15 days prior to the Event start date: no refund
• No-shows or withdrawals after an Event has commenced: no refund

9.3 Event Cancellation by Pathway Hockey

In the event that Pathway Hockey cancels an Event due to circumstances beyond its reasonable control (including but not limited to severe weather, ice conditions, public health emergencies, or government orders), Pathway Hockey will endeavour to reschedule the Event or offer a partial or full credit toward a future Event. Pathway Hockey shall not be liable for any travel, accommodation, or other costs incurred by teams or Guardians in connection with a cancelled or rescheduled Event.

10. Insurance

Pathway Hockey may hold general liability insurance in connection with its Events. However, this insurance does not cover personal accident insurance or medical expenses for individual Participants. The Guardian is solely responsible for ensuring that the Participant has appropriate personal accident insurance coverage (including extended health benefits) prior to participation.

Hockey Canada member associations typically provide coverage under the Hockey Canada Insurance Program. It is the Guardian’s responsibility to confirm the scope of any such coverage and to obtain supplemental coverage if required.

11. Venue Rules and Ice Allocations

All teams, Participants, Guardians, and spectators must comply with the rules and regulations of the host arena and any other Event venue. Ice allocations and game scheduling are at the sole discretion of Pathway Hockey and are subject to change without notice based on ice availability, weather conditions, or other operational requirements. Pathway Hockey does not guarantee any specific game times or ice allocations.

12. Force Majeure

Pathway Hockey shall not be liable for any delay, cancellation, or failure to perform its obligations under this Agreement caused by circumstances beyond its reasonable control, including but not limited to: acts of God, pandemics, epidemics, public health orders, government restrictions, severe weather, natural disasters, fire, power outages, or third-party failures. In such circumstances, Pathway Hockey shall notify affected parties as soon as practicable and will endeavour to provide alternative arrangements where reasonably possible.

13. Intellectual Property

All logos, branding, trademarks, website content, and materials associated with Pathway Hockey and the Origins Girls Hockey Showcase are the exclusive property of Pathway Hockey or its licensors. No team, Guardian, or Participant may reproduce, distribute, or use any Pathway Hockey branding or materials for commercial purposes without prior written consent from Pathway Hockey.

14. General Provisions

14.1 Severability

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from this Agreement and the remaining provisions shall continue in full force and effect.

14.2 Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior communications, representations, or agreements, whether oral or written.

14.3 Amendments

Pathway Hockey reserves the right to amend these Terms of Service at any time. Material amendments will be communicated to registered Guardians by email. Continued participation in Events following any such amendment constitutes acceptance of the revised terms.

14.4 Waiver

No failure or delay by Pathway Hockey in exercising any right under this Agreement shall constitute a waiver of that right. A waiver of any breach of this Agreement shall not be deemed a waiver of any subsequent breach.

14.5 Governing Law

This Agreement is governed exclusively by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from this Agreement shall be resolved in the courts of Alberta.
